These Terms of Service (the “Terms”) are a legal agreement between you and ONG Consulting, LLC, doing business as Fortress Mussel Control (“ONG,” “we,” “us,” or “our”), and govern your access to and use of the website located at musselcontrol.com, including any content, functionality, forms, and services offered on or through it (collectively, the “Site”).
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, do not access or use the Site.
The Site is intended for use by businesses, municipalities, utilities, engineers, and other professionals evaluating fouling control for raw water intakes and transmission lines. If you are using the Site on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and “you” refers to both you and that organization.
We may revise these Terms at any time and for any reason. Any changes are effective when posted, and we will alert you by updating the “Last Updated” date at the top of this page. You are responsible for reviewing these Terms periodically. Your continued use of the Site after changes are posted means you accept the revised Terms.

The Site describes copper ion technology, Fortress Mussel Control systems, cost comparisons, case studies, and news related to the control of zebra mussels, quagga mussels, and other fouling organisms. This content is provided for general informational purposes only.
Every raw water intake is different. The suitability, design, sizing, and performance of any fouling control system depend on site-specific conditions, including water chemistry, flow rates, intake configuration, existing infrastructure, and applicable environmental permits and regulations. Nothing on the Site is an engineering analysis of your facility, a guarantee of results at your facility, or a substitute for a written proposal and engagement with our professionals. You should not act on information from the Site without obtaining such an engagement or your own qualified professional advice.
Cost comparisons, performance figures, and treatment results published on the Site reflect the conditions and assumptions stated with them. Results at other locations may differ.
The Site does not sell products or services online. Fortress Mussel Control systems, engineering, installation, monitoring, and related services are provided only under a written proposal, quotation, purchase order, or contract signed or accepted by ONG (each, an “Agreement”). Pricing, delivery, warranties, performance commitments, and all other commercial terms are governed exclusively by the applicable Agreement.
Information on the Site, including any pricing or cost information, does not constitute an offer and may be changed at any time without notice. If there is any conflict between these Terms and an Agreement, the Agreement controls with respect to the products and services it covers.
The Site allows you to contact us through forms, email, and telephone. When you submit information to us, you represent that it is accurate and that you have the right to provide it. Please do not submit information you consider confidential or proprietary through the Site unless we have agreed in writing to receive it under a confidentiality agreement.
By submitting an inquiry, you authorize us to use the information you provide to respond to you, to evaluate your project, and to contact you about our products and services. Our collection and use of personal information is described in our Privacy Policy.
When you use the Site, submit a form, or send us an email or text message, you are communicating with us electronically. You consent to receive communications from us electronically, including by email, telephone, and text message as described in these Terms, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
If you provide a telephone number, you agree that we may call you at that number regarding your inquiry or project. We will send text messages or make calls using automated technology or prerecorded messages only where you have given the consent required by applicable law, and you may withdraw that consent at any time as described below.
Fortress Mussel Control (ONG Consulting, LLC) offers a text messaging program (the “SMS Program”) to communicate with customers, prospective customers, and project contacts. By providing your mobile phone number and opting in (for example, by checking the SMS consent box on a form on the Site, texting us first, or giving written or verbal consent to our team), you agree to receive recurring text messages from Fortress Mussel Control at the number you provided. These messages may include responses to your inquiry, quotes and proposals, project scheduling and updates, service and monitoring notifications, appointment reminders, and customer support. If you separately opt in to marketing messages, we may also send information about our products, services, and industry news.
We may modify or discontinue the SMS Program at any time. These SMS terms are part of these Terms of Service.
The Site and its entire contents, features, and functionality, including all text, graphics, images, illustrations, diagrams, videos, logos, and the design, selection, and arrangement of the Site, are owned by ONG or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
“Fortress Mussel Control,” “FMC,” “ONG,” and the related logos are trademarks of ONG Consulting, LLC. Other names and marks appearing on the Site are the property of their respective owners and are used for identification only. Nothing in these Terms grants you any right to use our trademarks without our prior written consent.
We grant you a limited, revocable, non-exclusive license to view, download, and print pages from the Site for your own internal business evaluation of our products and services. You may not otherwise reproduce, distribute, modify, create derivative works from, publicly display, republish, or exploit any content from the Site without our prior written permission.
The Site may include news items, reports, and excerpts that originate from third parties, such as water authorities, utilities, and publications, and may link to third-party websites. We provide this material for your convenience. We do not control third-party websites or content, we are not responsible for their accuracy or availability, and a link or reference does not mean we endorse the third party or that the third party endorses us. Your use of third-party websites is subject to their own terms and policies.
The Site uses cookies and similar technologies, including cookies set by third-party services such as analytics, security, spam-protection, and embedded video providers. These technologies help the Site function, keep it secure, and help us understand how visitors use it. This disclaimer applies to the Site only. Warranties for Fortress Mussel Control products and services, if any, are stated solely in the applicable Agreement.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ONG, ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR ANY CONTENT ON IT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, OUR TOTAL LIABILITY ARISING OUT OF YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. This section does not limit any liability that cannot be limited under applicable law, and it does not apply to liability under an Agreement, which is governed by that Agreement.
You agree to defend, indemnify, and hold harmless ONG and its members, managers, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your violation of these Terms or your use of the Site, including any information you submit through it.
These Terms and any dispute arising out of or related to them or the Site are governed by the laws of the State of Texas, without regard to its conflict of law principles. You agree that any legal action arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Rockwall County, Texas, and you consent to the personal jurisdiction of those courts. Before filing any action, you agree to first contact us using the information below and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
These Terms, together with our Privacy Policy, are the entire agreement between you and ONG regarding your use of the Site and supersede any prior understandings regarding the Site. They do not replace or modify any Agreement. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our written consent; we may assign them without restriction.
